Gearbox Problems

Appreciate the comments made earlier - I'll wait and see what comes back from him re costings. I did detail on the receipt "sold as seen tried and tested" , which as I understand covers any eventuality with the car once it's taken away.

This guy's now come back to me and said his mechanic has quoted him 2,700 euros (!) "to repair gearbox, clutch and hours " and has been very noble in suggesting he'll pay for the clutch "and we'll share the rest of the cost between us" ! What would you do ?
As discussed earlier in the thread this is, of course a secondhand car sold with a receipt stating "sold as seen tried and tested" and once the car left my house driven around 600 miles to south of Paris - so I welcome any comments people may have ! - At times like this I try to put myself in the opposite position and question would I be sending e-mails saying a secondhand car had had a problem on a 600 mile journey home ? and the answer is NO I'd take it on the chin as a "hazard" of buying an older car - if I wanted a flawless drive with a warranty I'd buy a new car from a dealer ! I'd welcome any comments people have but re-reading I feel I've answered my own question !
 
Once he dicided to buy, it his to maintain. Its harsh but unless you knew of a problem before selling then, it his car.
 
There was a guy posted yesterday offering a new box for £1400 anyway - point him at that Steve.

Having spoken to you, you are clearly an honest guy and am sure if you felt in anyway responsible or knew of any issues you would have offered to help ...

Sold as seem is sold as see. He took the car and on the way or when he got home the gearbox failed. He could have ragged the car for a bit, dropped the clutch, drove it hard...you dont know. The same happened to a friend of mine with an RS Turbo years ago. He sold it and when the buyer got home the head gasket was blown. My mate never coughed up a penny as it was 'sold as seen'. The car was ok when he sold it. Like I say, the new buyer could have created the problem with the gearbox. Besides, he lives in France...what is he going to do?

I agreee the guy could of ragged it all the way home and driven it like an animal.

I would not expect any money back, BUT I WOULD ASK AND GET A BIT SHITTY ABOUT IT just in case the seller was a soft touch.

If you did know of an issue, then you should really have told him, If you didnt know of any issues prior to sale / or wasnt any issue then no chance.

so ? I find this a weird point of view. You dont buy eggs but a V6. If the box was ok, you can drive it like a twat like any other car. Point is, sold as seen, so in fact you own him nothing. If you want to share the costs, thats the passion for the V that talks and respect for that. I would do the same.

btw, both gearboxes are sold. I can get 2 new ph1 boxes now for 770 £ / 900 € p.p (bargain!). Will start an new topic on this.

Here's my opinion:
A vee is not like other cars , it has huge tyres with a huge engine sat on top so the tyres don't spin (like a 182for example) the engine has a phenominal amount of torque and power , and the clutch plate is huge (and strong)(moreso on phase1) ... where does that leave us ... the gearbox! This takes the brunt of it all and if you drive 600 miles in 4th at 65000RPM and keep whapping the throttle open to hear your new car's engine or if you're used to LHD and you get a full throtle gearchange badly wrong it will destroy this box.
My box has about 10,000 miles left in it with good spirited but careful use but I could go out right now and finish it off in under 100 miles guaranteed!

"Sold as seen" has no legal standing in the UK ...

As a private sale, the new owner is entitled to return the car for a full refund (within a few days(forget how many)) if there is any major problem! That said , this guy has driven over 600 miles and exported it to a different country ! He has no legal standing to ask you for a gearbox donation , nor do we have any proof of what he is claiming, could all be BS to get another 1000 euros off the sale price !
Even the smallest motor dealer in the UK is legally obliged under UK law to offer a 3 month unconditional warrant on EVERY car he sells (they never tell you this, they just get you to buy one of those crappy insurance warrantys instead!) If the dealer doesn't co-operate , you are legally allowed to drive it back through his showroom window !

So if you're not a dealer you're in the clear ... for future reference , the correct legal wording that should be written at the top of the receipt is "sale of unroadworthy motor vehicle" not sold as seen ... if you write this then it doesn't matter if you're a dealer or if the car is a bag of shit ... I love English law ! being a resident of France he would never be able to summons you to UK magistrates anyway haha!

That said , you only had the car for 1000 miles and you're already looking for another one (and you had one of the best/black/gold low miles) so it would appear a bit suspicious !

If the box was fine and you know it , then you shouldn't even be talking to this guy ... like mentioned by other members , he may just be trying it on ! ... if it is your concience annoying you because you might have heard the odd whine for example then you could offer a couple of hundred Euros to make yourself feel better.(not recommended though, donating even a penny to this bloke will change your legal standing for the worse!)

At the end of the day , it is hard luck for him and I recommend you stop communicating with him immediately.
